      1 March 1858, Miles pat. 39 94/100 acres in S3T6SR12W SE¼SW¼, Franklin Co., at Huntsville land office (vol. 34, p. 125, #26547). I have a copy of the patent.

      Also on 1 March 1858, he pat. 119 79/100 acres S3T6SR12W SE¼NW¼ and SW¼NE¼, Franklin Co., at Huntsville land office (name spelled as Miles R. Lindsay) (vol. 380, p. 99, # 22626A). I have a copy of the patent.

      1 Dec. 1859, Miles pat. 159 73/100 acres in S3T6SR12W W½NW¼ and W½SE¼, Franklin Co., at Huntsville land office (vol. 388, p. 280, #28748). I have a copy of the patent.

      1860 census, Franklin Co., AL, Eastern subdivision, p. 588, LaGrange post office (361/360). Miles R. Lindsey is 29, farmer, $1000 real, $500 personal, b. SC. Wife Jane is 31, b. SC. In the household are children Wm. R., 10, Franklin F., 8, Martha A., 6, Amos L., 5, Mary L., 4, Cynthia A., 2, and Amanda L., 3 months. All are b. AL.

      Miles is on an 1866 IRS tax assessment list for division 5 of tax assessment district 3, state of AL, listing those owing special excise taxes. He's taxed for 20 gallons of brandy in September of the previous year.

      Miles is on the 1866 AL state census in Franklin Co. with 1 m. over 20, 5 females under 10, 2 females 10-20, and 1 female over 20. Neighbors are Martha Hester and Marcus Elledge.

      1870 census, Franklin Co., AL, p. 476, twp. 6, range 12, Frankfort post office (38/38). Miles is 49, farmer, b. SC, $1000, $774. Jane is 42, b. SC. In the household are children William, 10, George, 18, Martha, 17, Mary, 13, Amos, 15, Cynthia, 12, Oscar, 7 Lawson, 3, and Modena, 1, as well as Thomas Sparks, 17, b. GA. All are children b. AL and George is teaching school. Here, Mary appears older than Amos. Thomas Sparks is evidently a relative of Miles's mother Anna, whose sister Eunice married William Sparks. Thomas Sparks's death certificate says his parents were Coleman Sparks and Lizzie Holland. He died at Leighton in Colbert Co. and is buried at Tuscumbia in Colbert Co. He married Mollie Norwood in Lawrence Co. in 1879.

      Note that house 37/37, Sarah Elledge's, has Martha Hester and her children in the household. Martha must be a relative of William H. Hester, husband of Miles's sister Melissa?

      House 40/40 is the family of Robert and Mollie Hendrix, and 43/43 is the household of William and Nancy Hendrix, both b. SC. These Hendrixes would seem to be relatives of Miles' mother Anna Woodruff, whose sister Sarah m. a William Hendrix.

      Note that this census implies Mary is younger than Amos, but if I am reading Amos's bible register correctly (see his file), he was b. 1857, where this census show Mary b. 1856.

      Dorothy Gaines (see file of Dennis, father of ML) has sent me an undated affidavit from Riley Sparks, cousin of ML, which is evidently from the claims file of ML for reimbursement from the federal government after the Civil War, per the claims filed with the Southern Claims Commission. This states that RS lived near ML during the War, and that ML had consistently supported the Union.

      Dorothy Gaines is correct: according to Gary B. Mills, Southern Loyalists in the Civil War: The Southern Claims Commission (Baltimore, MD, USA: Genealogical Publishing Company, 2004), p. 363, Miles R. Lindsey did file a claim in 1878 in Franklin Co., AL. It's file 16521, office 51, report #8. It was disallowed.

      Dorothy Gaines' letter accompanying this tells me that Miles Lindsey is a son of Dennis and Anna Woodruff Lindsey, and that Riley Sparks is a son of Eunice Woodruff, sister of Anna.

      The July 1995 letter of Dorothy Gaines cited in file of Dennis Lindsey who married Anna Woodruff contained an FGS chart for ML. Unless otherwise noted, this is my source for all information I have recorded about this family. The letter also had FGS charts for the families of Wm. R. and Asa D. Lindsey; unless otherwise noted, this is my source for all information I have recorded about them.

      The death certificate of Lawson P. Lindsey, son of Miles R. Lindsey, gives Lawson's mother's name as Jane Williams. I have a copy of the original death certificate.

      Dennis was living in Franklin County, Alabama in the 1850 US Census. He was also living in Franklin County, Alabama in the 1840 US Census.

      So, what we do, to prove the parent/child relationship, is to gather as much evidence as we can find, and then compile a proof argument. This is totally acceptable, since the County records were destroyed in a courthouse fire/disaster.

      The Alabama State Census has age categories for the family members, and the 1860 and 1870 US Census both show that Miles was born 1821 (age 39 & 49, respectively).

      1866 shows he was 40-50. But this could be an error, and perhaps the census taker ticked the wrong column for his age. Because the US Census was 10 years apart and the US census was also consistent with his age, we will go with that data.

      In looking at the 1840 US Census for Dennis, I note that his immediate neighbor was Thomas Moody. Joel Moody was a neighbor of Miles' land. Dennis has the following males in his 1840 US Census household: 1 male age 10-14; 1 male age 20-29 and 1 male age 40-49. The 1850 US Census shows that Dennis was age 57, and he would have been the 40-49 year old in 1840.

      Right beside Dennis in the 1850 US Census, we find Robert Linsey, age 20. Robert would have been age 10 in the 1840 US Census and would have been the youngest male, who was age 10-14.

      This leaves the male age 20-29 unaccounted for.

      Miles was born 1821 and would have been age 19 in 1840. So, he very well could have been the male who was age 20-29.

      There were only a couple other Lindseys/Lindsays in the 1850 US Census, Franklin County, Alabama around Miles' age:-D.R. Lindsay, age 20 and born in Scotland-Caswell Lindsey, age 37 and born 1813 in Tennessee.

      Caswell has three children would would have appeared in the 1840 US Census. And I see no household matching his family, or his age.

      Caswell Lindsey is in District #6 in the 1850 US Census, Franklin County, Alabama, family number 973. Dennis is also in District #6, family number 774.

      In the 1850 US Census, both Dennis and Robert owned a little real estate.

      Both Miles are Robert were living in the Eastern Subdivision of Franklin County, Alabama in the 1860 US Census and Miles was family #360, Robert #690.

      Both Miles and Robert were living in Township 6, range 12 in the 1870 US Census, Franklin County, Alabama. Miles was family #38 and Robert was family #14. So, the two men were 24 households apart in 1870 and were close neighbors.

      Robert was still alive in the 1880 US Census, Franklin County, Alabama, dwelling 86, and that census shows that both parents were living in South Carolina. Miles' widow, Jane, was dwelling 146. So, the two families were 60 households apart.

      There are four grants for Robert D Lindsey in the BLM/GLO website. All were in twp 6, range 12, with exception of the grant in 1850, which was located in township 6, range 13. Robert's land was in sections 4, 5, & 9 and Miles' was in section 3. Miles also had land in township 6, range 13, section 11, whereas Robert's land was in section 13.

      Sections 3 and 4 are side by side bordering Colbert County on Tallison Creek. Both men had Hovarters and Hesters as neighbors.

      The interesting thing here is that Robert's grant in Township 6, Range 13, Section 13, was dated May 1, 1850. The US Census day wasJune 1, so I suspect that we can also place Dennis in this area, since Dennis was living beside Robert in the 1850 US Census. And Miles' grant in Township 6, Range 13, Section 11 was issued 13 January 1845. Miles' land was in the South East Quarter of section 11 and Robert's land was in the N/W Quarter of section 13. So, their land would have, again, been extremely close.

      Twp 6 Range 13 has also been platted and note the locations of Section 11 and 13. Above I noted that Miles was in the South East corner of his section and Robert was in the North West corner of his section. These graphs make it easier to visualize how close the two men lived.

      I would say that fact, in itself, combined with the fact that Dennis has a son about Miles' age in 1840, plus the fact that no other Lindseys had land grants in this area of the county, is pretty solid information to confirm that Dennis was probably father of Miles.

      Another factor to consider, Robert's US Census consistently states that he was born in Alabama and the 1880 US Census places his parents birth in SC, where we know Miles was born about 1821. Robert was born about 1829/30.

      We do find a 1830 US Census for Dennis Lindsay, in Lawrence County, Alabama. He is age 30-39, which is consistent with the 1840 and 1850 US Census. Dennis has the following males in 1830: 2 males 5-9; 3 males 10-14; 1 male 15-19 and 1 male 30-39. Robert would be under age 5 and Miles would be age 5-9. However, if Robert was born in 1830 and had not been born before the US Census date ofJune 1, he would not appear in the household.

      Robert's grave is marked and he is buried in the Hovater Cemetery. Robert's grave shows he was born June 3, 1829. So, if he were actually born in 1830, and not 1829, then he would not have been born before the US census day and would not have appeared in the family in 1830. Because birth dates on the tombstone were carved long after the person was born, and because the information would probably not have been provided by the deceased individual, birth dates on grave markers are not always reliable.

      Also, Lawrence County bordered Franklin County in the 1830 US Census. Because the family appears to fit and because Lawrence County was next to Franklin, I've attached the 1830 US census to Dennis on your tree. There are a few things you need to do from here:

      -Find out what happened to his slaves in 1830. He had no slaves in 1840-Search records in Lawrence County for your Lindseys-Also search records in neighboring Colbert County for your Lindseys. Both Miles and Robert had land that was within a mile of Colbert county, and there could be records for them in that county.-Research the neighbors and see if Dennis' neighbors were relatives of Miles' neighbors.

      The final thing I did this afternoon, was to look for Dennis in the 1820 US Census. I did find Dennis Lindsey living in Spartanburg, Spartanburg County, SC in the 1820 US census. He has one male under age 10; 1 male age 26-44 and 1 female age 16-25.

      If Miles were born in 1821, he would not have appeared in this household. However, the 1840 US Census shows that Miles was age 20-29, and that puts his age in 1820 under 10. That fits well. However, there is one problem and that is Dennis' 1830 US Census household. This shows that he has about 4 males & 1 female, who would have been under age 10 in 1820.

      So, that is a bit of conflicting evidence that needs reconciliation. Were the children living with Dennis in 1830 his children, or perhaps children of a deceased relative? Was his wife the person found in his 1820 US Census household, or was it a second marriage for him, bringing her children along with her?

      Dennis had one slave in the 1820 US Census. If we could get the slave's name, and find names of his slaves in Alabama, we could connect the to Dennis Lindseys. If we check records in Lawrence County, Alabama for him, we may get more information.

      The research today, has pretty conclusively shown us that your Miles Lindsey owned land near Robert Lindsey and that Robert was living next to Dennis in 1850. Robert also shows his father was born in SC, where we know Miles was also born. So, I think that answers your question about Miles being son of Dennis.

      I recommend that you search the neighboring counties, in case Dennis had land or a probate there. And definitely search Lawrence County, to prove that Dennis was the person living there in 1830. And take a long hard look at the neighbors.

      I've used the remainder of your time researching Miles. I have established that he is probably son of Dennis. There are a few other things you will want to do to further confirm this and confirm that Dennis living in Lawrence County, Alabama is your ancestor.
